What is the Nokia Reseller Network?
Nokia and the Reseller Marketplace by eBay have come together allowing eBay’s PowerSellers to become official Nokia e-Tailers through the Nokia Reseller Network. PowerSellers who purchase phones and accessories in bulk directly from Nokia in the Reseller Marketplace will be automatically enrolled in the Nokia Reseller Network.
How does it work?
All PowerSellers can login to the Reseller Marketplace and view Nokia’s listings for handsets and accessories. The PowerSeller who wins a Nokia auction and completes the payment per the terms of the listing will be automatically enrolled in the Nokia Reseller Network. Nokia will ship to the PowerSeller the product that the PowerSeller will be authorized to use on their eBay.com listings.
So long as the program member does not violate the Terms of Agreement, the member will continue to be authorized by Nokia to resell all Nokia product purchased through the Reseller Marketplace by eBay.

TERMS AND CONDITIONS OF SALE
Credit Line; Credit Approval: Upon approval of this application, BRIGHTPOINT, in its sole discretion, will assign APPLICANT a maximum credit line and shall have the right to increase, decrease, or terminate APPLICANT’s credit privileges under this Application at any time without prior notice to APPLICANT, except as otherwise provided by law. All orders are subject to acceptance and approval of credit by BRIGHTPOINT. BRIGHTPOINT may, from time to time and in its sole discretion, disclose credit information relative to the APPLICANT to third parties for informational purposes only.
Payment: APPLICANT agrees to pay all charges according to the payment terms established in each invoice for products and/or services it acquires from BRIGHTPOINT. APPLICANT waives any right it may have at law, in equity, under contract or otherwise to set-off or exercise any similar remedy against BRIGHTPOINT, in whole or in part, any sum that may from time to time be owing by the BRIGHTPOINT to APPLICANT. The entire outstanding balance due on all invoices shall become due to BRIGHTPOINT in full immediately upon default in the payment of any invoice. APPLICANT agrees to pay interest in the amount of 1.5% per month, or the highest rate permitted by law, whichever is less, on any payment past due, pursuant to the terms set forth on each invoice until collected. In order to secure APPLICANT’s obligations under this Agreement, including its obligation to pay any amounts it owes to BRIGHTPOINT when due, APPLICANT grants to BRIGHTPOINT a security interest in all products sold by BRIGHTPOINT to APPLICANT. APPLICANT agrees to execute, deliver to BRIGHTPOINT, and permit BRIGHTPOINT to file any financing statements necessary in BRIGHTPOINT’s sole determination to perfect BRIGHTPOINT’s security interest in such products. APPLICANT appoints BRIGHTPOINT as APPLICANT’s agent for the purpose of executing, delivering and filing any such financing statements.
Purchase Orders: A written purchase order is required for all first time sales and thereafter for any order for goods in excess of $5,000. This Agreement and the terms and conditions of each invoice shall control and prevail over any contrary terms in APPLICANT’s purchase order.
Accurate Information: APPLICANT hereby certifies that the information furnished under this application and on any financial statements furnished in connection herewith is true and correct and that this information is being furnished to BRIGHTPOINT for the purpose of inducing BRIGHTPOINT to extend credit to APPLICANT, and understands that BRIGHTPOINT intends to rely upon such information as correct.
Force Majeure: BRIGHTPOINT shall not be responsible for delays in deliveries due to events of force majeure, including, but not limited to, fire, flood, tornado, earthquake, war, riot, insurrection, strike, lockout, slowdown, epidemic, quarantine restriction, delay in transportation, labor shortage or strikes, materials or manufacturing facility shortage, accidents, boycott, embargo or any act or regulation of government or governmental authority and other contingencies beyond BRIGHTPOINT’s control resulting in impossibility or delay of performance of BRIGHTPOINT.
Shipping; Risk of Loss: All deliveries will be made FOB BRIGHTPOINT’s designated shipping point. Freight will be on a prepay and add basis, unless otherwise agreed in writing by an authorized signatory of BRIGHTPOINT. BRIGHTPOINT shall not be responsible for spotting, switching, demurrage or other transportation charges unless agreed in writing. Risk of loss, damage to and title to products shall pass upon delivery thereof to APPLICANT’s carrier, FOB shipping point. Upon receipt of shipment, it shall be the responsibility of APPLICANT or the consignee receiving shipment to inspect the products and secure written acknowledgement from delivering carrier for any shortages, loss, damage or nonconformance. APPLICANT shall notify BRIGHTPOINT in writing within five days of receipt of any shipment of any shortages, defects or non-conforming products. In the event APPLICANT fails to notify BRIGHTPOINT with such five day period of any shortages, defects or non-conforming products, the products shall be deemed accepted.
Prices: APPLICANT shall purchase products in accordance with prices, as determined by BRIGHTPOINT, that are prevailing at the time of shipment.
WARRANTY; DISCLAIMER OF WARRANTIES: BRIGHTPOINT shall, to the extent permitted, pass through to APPLICANT such warranties as are provided to BRIGHTPOINT for such product for each product purchased by APPLICANT pursuant to this Agreement. THE MANUFACTURER’S WARRANTY PASSED THROUGH BY BRIGHTPOINT TO APPLICANT HEREUNDER, IF ANY, SHALL BE IN LIEU OF ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
LIMITATION OF LIABILITY: BRIGHTPOINT SHALL HAVE NO LIABILITY FOR (I)
FAILURE TO DELIVER PRODUCTS OR SERVICES WITHIN A SPECIFIED TIME PERIOD, (II) AVAILABILITY AND/OR DELAYS IN DELIVERY OF PRODUCTS OR SERVICES, (III) DISCONTINUATION OF PRODUCTS, PRODUCT LINES, OR ANY PART THEREOF; OR (IV) CANCELLATION OF ANY ORDERS. BRIGHTPOINT SHALL HAVE NO DUTY TO DEFEND, INDEMNIFY OR HOLD HARMLESS APPLICANT, ITS AFFILIATES OR THEIR RESPECTIVE CUSTOMERS FROM AND AGAINST ANY CLAIM, DEMAND OR CAUSE OF ACTION, INCLUDING ANY DAMAGES, COSTS OR EXPENSES INCURRED BY APPLICANT, ITS AFFILIATES OR THEIR RESPECTIVE CUSTOMERS IN CONNECTION WITH, ARISING FROM OR RELATING TO THE ACTUAL OR ALLEGED PRODUCT LIABILITY OR VIOLATION OR INFRINGEMENT OF ANY PATENT, TRADEMARK, COPYRIGHT OR OTHER INTELLECTUAL PROPERTY BELONGING TO A THIRD-PARTY BY THE PRODUCTS.
APPLICANT’S, ITS AFFILIATES’ AND THEIR RESPECTIVE CUSTOMERS’ SOLE AND EXCLUSIVE REMEDY RELATING TO THIS AGREEMENT AND/OR PRODUCTS AND SERVICES SHALL BE THE REMEDY, IF ANY, AFFORDED BY THE MANUFACTURER OF SUCH PRODUCTS TO SUCH PARTIES. TO THE FULLEST EXTENT PERMITTED BY LAW, APPLICANT WAIVES ANY CLAIMS, DEMANDS, CAUSES OF ACTION OR RECOVERIES FOR PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES ARISING UNDER THIS AGREEMENT OR OTHERWISE WITH RESPECT TO THE SALE OF THE PRODUCTS OR SERVICES, INCLUDING, WITHOUT LIMITATION, LOST REVENUES OR PROFITS, CONSEQUENTIAL OR INCIDENTAL DAMAGES, INJURY TO PERSONS OR PROPERTY, BUSINESS INTERRUPTION OR DAMAGE TO BUSINESS REPUTATION, REGARDLESS OF THE THEORY UPON WHICH ANY CLAIM MAY BE BASED, AN EVEN IF BRIGHTPOINT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING ANY TORT OR STATUTORY CAUSES OF ACTION. THE ONLY LIABILITY BRIGHTPOINT WILL HAVE WITH RESPECT TO ANY DAMAGED PRODUCTS, DEFECTIVE PRODUCTS, AND/OR PRODUCTS ERRONEOUSLY SHIPPED WILL BE THE RETURN RIGHTS DESCRIBED HEREIN. EVEN IF THIS AGREEMENT FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT WILL BRIGHTPOINT’S ENTIRE LIABILITY (IN TORT, CONTRACT, WARRANTY, INFRINGEMENT OR OTHERWISE) TO APPLICANT EXCEED THE PURCHASE PRICE ACTUALLY PAID BY APPLICANT FOR THE PRODUCTS OR SERVICES THAT GIVE RISE TO THE DISPUTE, OR ANY DEFECTIVE PORTION THEREOF, WHICHEVER IS THE LESSER AMOUNT. THIS PROVISION SHALL SURVIVE THIS AGREEMENT.
Indemnity: APPLICANT shall defend, indemnify, and hold harmless BRIGHTPOINT, its affiliates and subsidiaries and each of their respective officers, directors, employees and agents from and against any and all claims, demands, proceedings, actions, liabilities, losses, damages, costs or expenses of any kind (including reasonable attorneys’ fees and disbursements) incurred or sustained as a result of, or arising out of, or relating to any actions taken by BRIGHTPOINT regarding the products at the request of, and consistent with, instructions provided by purchaser, any breach of this Agreement or acts or omissions of APPLICANT or its employees, affiliates or agents, the manner in which APPLICANT markets and sells the products, supply by APPLICANT of any products or services for use in conjunction with or in relation to the products, or any breach or alleged breach of any applicable laws or regulations relating to the storage, marketing or sale by APPLICANT of the products.
Governing Law and Forum: This Agreement shall be governed by and interpreted in accordance with the laws of the State of Indiana, United States of America; provided, however, that any and all disputes hereunder shall be decided exclusively by litigation in state or federal courts located within Marion County or the Southern District of Indiana, Indianapolis Division, United States of America.
No Returns; No Refunds: Products are returnable only as provided herein. Products otherwise shall be non-returnable and the prices shall be non-refundable. APPLICANT may only return erroneously shipped products or products that were damaged prior to shipment by BRIGHTPOINT. Products damaged after shipment by BRIGHTPOINT may not be returned. In order to be eligible to receive credit for returned products APPLICANT must adhere to BRIGHTPOINT’s then current returns processing guidelines. BRIGHTPOINT reserves the right to charge a restocking fee for handling product that is erroneously returned. BRIGHTPOINT’s sole liability for any returned products will be acceptance of their return and issuance of credits pursuant to BRIGHTPOINT’s then current returns processing guidelines. If APPLICANT desires to return any products, APPLICANT must initiate a new order for the replacement products. All Products erroneously shipped by BRIGHTPOINT must be returned with the original packaging intact (including manufacturer’s shrink wrap) and otherwise in unused, resalable condition.
Product Restrictions and Obligations: APPLICANT agrees to at all time adhere to BRIGHTPOINT’s current Product Restrictions and Obligations Policy.
General: No modification hereof shall be binding upon either party unless the modification is in writing and signed by a duly authorized representative of both parties. The failure of BRIGHTPOINT to insist, in any one or more instances, upon performance hereunder, or to exercise any right hereunder, is not a waiver of the future performance of any term, covenant or condition or the future exercise of such right. APPLICANT shall pay to BRIGHTPOINT all costs and expenses, including, without limitation, reasonable attorney’s fees and the fees of any collection agency and court costs, incurred by BRIGHTPOINT in exercising any of its rights or remedies hereunder or enforcing any of the terms, conditions or provisions hereunder. If any provision of this Agreement is unenforceable, such unenforceability shall not affect the remainder of this Agreement unless a failure of consideration would thereby result. This Agreement shall be binding upon and, except as otherwise provided herein, shall inure to the benefit of the parties hereto and their respective successors and assigns. APPLICANT may not assign or transfer this Agreement or any of its rights or obligations. The rights and remedies granted herein are non-exclusive to those otherwise available in equity. The terms and conditions of this contract and of any sales and payments made pursuant thereto are performable in Marion County, Indiana.

How will I receive the product?
Upon winning an auction, the winning Powerseller will be contacted by Brightpoint. Brightpoint is a Nokia independent contractor responsible for shipment fulfillment of the products auctioned by Nokia on the eBay Private Marketplace. Once Brightpoint receives payment from the PowerSeller per terms of the listing, the shipment will be sent according to the Terms and Conditions agreed to at the time the bid was placed.
How much will shipping cost?
The shipping costs will be listed on each Nokia listing in the eBay Private Marketplace.
Can we resell these products through other outlets?
The Nokia Reseller Network is a unique opportunity for PowerSellers to work directly with Nokia. The pricing and availability of these Nokia products are strictly for the eBay Marketplace. If it is determined that a PowerSeller in the Nokia Reseller Network is not using the products for the purposes intended, Nokia has the right to bar the PowerSeller from any future participation in the Nokia Reseller Network.
What if I plan to sell my product under a different eBay username?
PowerSellers who plan to use alternative usernames to sell Nokia product must notify Nokia so that they are recognized as a member of the Nokia Reseller Network.

In the registration process by pressing the "Accept" button at the bottom of the page, the user is implicitly indicating s/he has read and agreed to the Terms and Conditions and Privacy Policy.
This agreement outlines the general terms and conditions applicable to the use of the services offered by www.mxporting.com hereinafter "MXPORTING" which is a site of Hemisferio Net for establishing business relationships between Sellers and Buyers. Any buyer wishing to access and / or use the site or services may do so subject to the Terms and Conditions.
ANY BUYER THAT DOES NOT ACCEPET THESE GENERAL TERMS AND CONDITIONS, WHICH HAVE AN OBLIGATIONAL AND BINDING CHARACTER, MUST REFRAIN FROM USING THE SITE AND / OR SERVICES.
The buyer should read, understand and accept all the conditions set out in the Terms and Conditions.
1. Capacity
Services are only available to buyers who have legal capacity to contract. Buyers who do not have such capabilities may not use these services.
2. Amendments to the Agreement
Mxporting may amend the Terms and Conditions at any time by making them public in the Site. All modified terms will come into force as soon as they are published and users will be notified by mail.
3. List of Goods
3.1. Protection of Intellectual Property. The published articles do not violate the rights of intellectual and industrial property, and any other third party. Right holders will be able to identify and seek the removal of those items which, in his opinion infringe or violate their rights. Should Mxporting suspected of being committed or has committed an unlawful activity or infringement of intellectual property rights or industrial Mxporting reserves the right to take all appropriate measures to understand.
3.2 Users should verify the products information and verify all selling conditions, due to the fact that once a Buyer establishes an order to purchase it is full responsibility of the buyer.
4. Buyer Obligations
4.1 When confirming the purchase of an item the Buyer agrees to be bound by the terms of the sale included in the item description.
4.2 Buyers must pay in the conditions established for the goods they purchase.
4.2 Purchase will be considered valid only once they have been processed by the computer system and when the Buyer has paid to SOT (Secure Online Transactions is a company contracted by Hemisferio Net that will be in charge of verifying payments and of corroborating that the merchandise is indeed delivered to the buyer.) for the product. This in order to guarantee the buyer's money and the sellers payments
4.4 Once buyers press the "submit" button they are obliged to pay for the products and if fail to do so, will be sanctioned by the revocation of their membership of the site.
4.3 Buyers will take full responsibility for the products that they purchase.
5. Sellers Obligations
5.1 The Sellers must provide a full and clear description of the characteristics of the goods offered.
5.2 The Sellers must meet all sales obligations of quality, quantity, condition and size.
5.3 The Sellers must deliver the products to FedEx in the established time.
5.4 The Sellers in a prudent and reasonable manner must resolve all disputes that may arise with the user Buyers, exempting Mxporting and Hemisferio Net of all and absolute responsibility.
5.5 Sellers must provide and send all information and samples that are requested.
Taxes. As current tax rules, the buyer should demand invoice or ticket to the Mexican company as proof of the transaction.
6. Prohibitions and Sanctions
6.1 Buyers may not: (a) manipulating the prices of items, (b) insult or attack other users.
Such activities will be investigated by Mxporting and the offender shall be liable to suspension or cancellation of their user account.v
6.2 If a Buyer fails to pay for the product purchased s/he will be sanctioned by the cancellation of their user account.
6. Violations of system or Databases
The use of any action, device, software or other means intended to interfere with the activities, operations, descriptions, accounts or databases in Mxporting will be sanctioned. Any intrusion attempt or activity that violates or is contrary to the laws on intellectual property law and / or the prohibitions set forth in this agreement shall be subject to its responsibility for the appropriate legal action, and the penalties provided by this agreement, as well as make the buyer responsible and have them compensate for the damages.
7. Disclaimer Mxporting only makes available to Buyers, a virtual space that allows them to contact through the Internet sellers in order to buy goods. Mxporting is not the owner of the items offered and it does not have possession of them nor can it dispose of them for sale. Mxporting is not involved in the improvement of operations conducted between the Sellers and the Buyers, or for any conditions which they might agree upon. Mxporting is not liable regarding the existence, quality, quantity, condition, integrity or legitimacy of the offered goods acquired. Each Buyer knows and accepts to be the sole responsible for items purchased in Mxporting. The misuse of the "buy now" button can generate a penalty involving the cancellation of user account.
Because Mxporting has no participation throughout the time the article is published for sale, nor in the subsequent negotiation and refinement of the final contract between the parties, Mxporitng will not be responsible for the effective fulfillment of the obligations assumed in refining the operation. Mxporting is not responsible for the services provided by third parties, such as Cescemex, FedEx and SOT. Buyers know and accept this when conducting transactions with Mexican companies and third parties under their own risk.
Mxporting recommends caution and common sense when dealing with Sellers and third parties. Also, the buyer should verify all information regarding the products and if there is any doubt they should contact the company responsible before confirming their order. And if necessary request prior to a purchase, samples of the product.
Should one or more buyers or any third party initiate any claim or legal action against another or other expenses, each and every one of those involved in such claims or actions exempt from any liability Mxporting and its directors, officers, employees, agents, operators, agents and attorneys.
Mxporting is not in charge of managing the payments to the Sellers or the delivery of the products to the buyer. SOT will be responsible for receiving and holding the payments the buyers make to the Mexican companies for the products purchased, until the products have been delivered to FedEx. In case a company does not deliver the purchased good to FedEx, SOT will be responsible for returning the payment back to the buyer, subtracting the banking transactional fees. The Sellers will also be charged for the infringement.
8. Scope of services Mxporting
This agreement does not create any partnership contract, terms of reference, franchise or employment relationship between Mxporting and the Buyer and Seller. The Buyer understands and accepts that Mxporting is not a party to any transaction, nor does it have any control over the quality, safety or legality of the items advertised, truth or accuracy of the ads.
Mxporting is only responsible for generating promotion leading to the sale of products but does not guarantee the accuracy of the third-party advertising appearing on the site and will not be responsible for correspondence or contracts concluded with the Buyer and third parties.
9. Faults in the system
Mxporting not responsible for any damage, injury or loss caused by flaws in the system, on the server or on the Internet to the Buyer. Mxporting is not be liable for any viruses that could infect the Buyer´s computer as a result of its access, use or examination of the website or following any transfer of data, files, images, text, or audio content in it. Buyers may NOT attribute any responsibility or demand payment for lost profits, by virtue of damage resulting from technical difficulties or failures in the systems or the Internet. Mxporting does not guarantee access or uninterrupted and continuous use of the site. The system may eventually not be available due to technical difficulties or failures of the Internet, or any other circumstance beyond Mxporting control; in such cases will seek to restore as quickly as possible. Mxporting shall not be liable for any errors or omissions contained on its website.
10. Jurisdiction and Applicable Law
For all matters relating to the interpretation and compliance with these Terms and Conditions, the parties are subject to applicable laws and court of competent jurisdiction of the City of Mexico, D. F., and disclaim any jurisdiction other than by reason of their present or future domiciles may correspond. The procedures will be carried out in Spanish.

There are listings on this site placed by Merchants who might be able to ship your item immediately after the listing closes. Because all of these Merchants use FedEx as their carrier and they do not deliver to Post Office Boxes, having a Street Delivery Address on record avoids any delays in processing your purchase.

How do I find the product I want to buy? [top]
On the site you will be able find the "search" field so you can enter the keywords, which must be spelled correctly and specify attributes or descriptions of the item you want. You can also select the type of product, through categories provided.
How can I view all the purchases I've completed? [top]
Go to "My Account" and select "Buying Activity." On the Search page, select "ALL" from the Status option and click "Submit." Your buys from the last 60 days will appear.

No. MxPorting only allows on-line purchases.
What is the payment process? [top]
All payments for Mxporting items will be made via PayPal to SOT. SOT (Secure On-line Transactions), is a company in charge of verifying payments assuring that the merchandise offered is delivered to the buyer.
How do I make the payment and receive my products? [top]
You will be able to make on-line transactions from your Pay Pal account to SOT´s account in order to pay for your products and shipping fees. Once you have done this, in the established time FedEX will deliver your products to the agreed location.
Can I pay by other means other than PayPal? [top]

What happens if a company does not deliver the product? [top]
This is not likely to happen, however if a seller does not deliver the product to FedEx, SOT will return the payment made by the buyer only charging the corresponding bank transaction fees.

All purhcased items will be shipped by FedEx, the official carrier for MxPorting.com
Who will make the shipping arrangements? [top]
Sellers are responsible for initiating shipment using FedEx international ground shipping.
Why the shipping arrangements are made by the Mexican company?[top]
Because FedEx has a special program with preferential rates and discounts varying form 15-30%. This way the buyer will pay a considerable amount less for shipping.
How can I verify the shipment costs? [top]
The buyer will be able to verify the regular cost at www.fedex.com. All buyers will recieve emails from FedEx with tracking numbers for their shipments.
Who pays for shipping? [top]
Buyers pay for shipping directly to SOT's(Secure On-line Transactions) account via Pay Pal.
